General Terms and Conditions of Business (AGB)
Information for Consumers in respect of Distance Sales Transactions
as well as Customer Information for Contracts in Electronic Commerce
§ 1 Scope of application
The business relationships between us and the ordering party in the case of orders placed via the Internet Shop shall be governed by the following General Terms and Conditions as last amended at the time the order is placed.
§ 2 Contract conclusion
The presentation of our products on our website solely implies an invitation to the Customer to submit a contract offer.
By sending us an order, the Customer is submitting an offer within the meaning of Section 145 of the German Civil Code (BGB). The Customer shall be notified via email with confirmation that the order has been received.
The contract with us shall become effective if we accept the Customer’s offer within 2 working days in writing or in text form after the order was received. The relevant date in this respect shall be the date the Customer receives the statement of acceptance.
A working day shall mean any day that is not a Sunday or a statutory public holiday observed throughout Germany.
§ 3 Delivery, Shipping costs, Risk transfer
Deliveries shall be made according to the shipping costs stated in each individual instance. If the Customer is also the Consumer, we shall assume the risk of loss or damage in any event, regardless of the shipping method. In cases where the Customer is an entrepreneur or business owner, all risks and dangers of shipping shall pass to the Customer once we have handed the goods to the commissioned logistics partner.
§ 4 Retention of title
We shall retain title to the goods delivered until the purchase price has been paid in full and received.
§ 5 Payments
Only the method of payment indicated by the Customer when the specific order was placed shall be accepted.
§ 6 Regulations regarding deposits/refunds for used or exchanged parts
Upon delivery of exchange parts, an additional deposit shall be necessary. The amount shall be specified in the respective item description. The deposit shall be refunded to the Customer when a similar and reparable used exchange part has been dispatched. The scope of the returned exchange part must correspond to the scope of the delivery. Please note that reparability is not available in the following circumstances:
seized up, cracked housing, missing parts, dismantled, broken or manually damaged parts, totally rusted compressor
disassembled steering gear, damage on the teeth of the steering shaft, damaged or over-torqued threads, damaged housing, missing add-on parts such as pressure hoses and tie rods, rusty steering rack, steering gear that has been replaced after an accident
Power steering pumps:
damaged supply line pipes, broken housing covers, shafts which have been removed from the power steering pump or which have been damaged, broken/crushed housing or damaged threads, worn-out shafts (pulley or adapter loose or dropped off), pulleys out of balance or damaged, adapter with damaged starter motor and
missing or dismantled parts, considerable corrosion, armature/rotor cannot be turned freely, burned-out, broken, damaged or deformed units.
Within Germany, used exchange parts shall be picked up free of charge. We shall assume the costs for the shipping of exchange parts from places outside Germany up to €15.90 upon proof of the actual costs.
§ 7 Liability for defects
The statutory provisions for defect liability shall apply.
§ 8 Information for Consumers in respect of Distance Sales Transactions as well as Customer Information for Contracts in Electronic Commerce
a) We are not subject to any special codes of conduct that have not been previously mentioned.
b) You can identify any input errors entered during the ordering process at the final confirmation before submitting your contractual declaration and correct the incorrect information at any time by using the “delete” and “change” functions before sending off the order.
c) For the essential features and characteristics of the goods we offer as well as the availability periods for limited time offers, please refer to the individual product descriptions on our website.
d) The language available for the conclusion of the contract shall be German.
e) You can put forward any complaints and claims based on liability for defects at the address shown in the provider/supplier identification (website host).
f) We shall not save the text of the contract and it is therefore unavailable at our website for your access as a Customer after the conclusion of the contract.
g) For detailed information regarding payment, delivery or performance please refer to the offer itself.
§ 9 Information on dispute resolution proceedings before a consumer conciliation board
We are neither prepared nor obliged to participate in dispute resolution proceedings before a consumer conciliation board.
§ 10 Miscellaneous
The contractual relationship between us and the Customer as well as the respective Terms and Conditions of Business shall be subject to the law of the Federal Republic of Germany. If the Customer is also the Consumer, any existing statutory provisions and rights to be applied for consumer protection in accordance with the laws of the state or country where the Consumer has his habitual residence and which may not be derogated from by agreement, shall remain unaffected by this agreement. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
